Pixes - Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the Pixes mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Pixes is a mobile application that allows users to create videos or apply effects to their photos using predefined templates. The App uses pay-as-you-go system for generating effects and videos.

3. Pay-As-You-Go System and Purchases

3.1 Pay-As-You-Go System

The App operates on a Pay-As-You-Go system where you pay for photo processing right before generating a video or effect.

3.2 In-App Purchases

Payment is handled via in-app purchases and processed by Apple Pay. All payment transactions are subject to Apple's terms and conditions.

3.3 No Refunds

All purchases are final and non-refundable, except as required by applicable law.

4. User Content

4.1 Ownership

You retain all rights to the photos you upload to the App. By uploading photos, you grant us a limited license to process and store your photos solely for the purpose of generating the requested effects or videos for you. We do not claim any ownership rights to your uploaded content, nor do we display or share your photos with other users or third parties except for the necessary processing service providers as outlined in our Privacy Policy. We do not store your photos or videos longer than it's needed for processing and download. All photos and videos are stored on your device.

4.2 Prohibited Content

You agree not to upload any photos that:

• Infringe on intellectual property rights
• Contain explicit, offensive, or illegal material
• Violate any third-party rights or privacy
• Contain malware or harmful code

5. Intellectual Property Rights

5.1 App Content

All content in the App, including but not limited to templates, designs, software, and logos, are the property of Pixes or its licensors and are protected by intellectual property laws.

5.2 Generated Videos

You own the videos and effects generated through the App, subject to our underlying rights in the templates and technology used to create them.

6. Prohibited Activities

You agree not to:

• Use the App for any illegal purpose
• Attempt to reverse engineer the App
• Circumvent any security features
• Use automated scripts to access the App
• Interfere with the App's operation or networks

7. Disclaimers and Limitations

7.1 "As Is" Service

The App is provided on an "as is" and "as available" basis without warranties of any kind.

7.2 Availability

We do not guarantee that the App will be available at all times or that it will be error-free.

7.3 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App.

8. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on the App or when otherwise notified. Your continued use of the App after changes constitutes acceptance of the modified Terms.

9. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any breach of these Terms.
